2. Description of Service

Seenable is an AI-powered product photography platform that transforms user-uploaded product images into professional, studio-quality photographs. The Service uses artificial intelligence to generate backgrounds, lighting, and environmental elements for commercial product imagery.

3. Account Registration

To use certain features of the Service, you must:

Create an account using Google OAuth authentication
Provide accurate and complete information
Maintain the security of your account credentials
Be at least 13 years of age (or the minimum age in your jurisdiction)

You are responsible for all activities that occur under your account.

4. User Content and Ownership

Your Content: You retain ownership of the original product images you upload to the Service. By uploading content, you grant us a limited license to process, transform, and store your images solely for the purpose of providing the Service.

Generated Content: Images generated by our AI based on your uploads are owned by you, subject to the following licensing terms based on your subscription:

Starter (Free): Personal use license only. Not for commercial purposes.
Pro: Full commercial license for use on ecommerce platforms, advertising, and marketing materials.
Studio: Full commercial license with extended rights for resale and client work.

5. Acceptable Use

You agree NOT to use the Service to:

Upload content you do not have rights to use
Generate images that infringe on third-party intellectual property rights
Create misleading, fraudulent, or deceptive product representations
Upload illegal, harmful, threatening, abusive, or objectionable content
Attempt to reverse engineer, decompile, or extract our AI models
Use automated systems to access the Service without permission
Resell, redistribute, or sublicense access to the Service itself
Interfere with or disrupt the Service or servers

6. Subscription and Payments

Free Tier: Limited to 3 image generations per month with standard resolution output.

Paid Plans: Subscription fees are billed monthly or annually as selected. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

Cancellation: You may cancel your subscription at any time. Access to paid features will continue until the end of your current billing period.

7. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate images. While we strive for high quality, AI-generated content may occasionally contain imperfections, artifacts, or unexpected results. Generated images are provided "as is." You are responsible for reviewing generated content before use and ensuring it meets your requirements and applicable regulations for product advertising in your jurisdiction.

8. Intellectual Property

The Service, including its original content, features, functionality, AI models, and technology, is owned by Seenable and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Seenable SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Seenable and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
